Nathan has worked closely with leading law firms in India to undertake competition assessment for various mergers and acquisitions in India. Our assessment included understanding the industry including demand and supply as well as the relevant regulation influencing the industry, determination of the relevant product and geographic markets, assessment of market shares and concentration in the market, analysis of efficiencies resulting from the proposed combination (if any), and assessing whether the proposed transaction is likely to adversely affect competition in the market based on factors such as barriers to entry, vertical integration, likelihood of a significant sustainable price increase, etc. Our expert economist reports were a part of the filings made to the Competition Commission of India (CCI). Nathan was part of the first Form II merger filing in India. Based on case requirements, we also represented clients at meetings with the CCI and provided them with analysis to assist them with divestment plans.
