The Moldova Institutional and Structural Reforms Activity (MISRA) is a five-year project funded by the US Agency for International Development (USAID) that aims to improve the business, investment, and trade enabling environment in cooperation with the Government of Moldova (GoM) to respond to an unprecedented economic crisis due to the war in Ukraine, as well as to support Moldova’s economic recovery, including to: advance the GoM’s economic action plan; strengthen public economic governance institutions; improve transport, logistics, trade, and commerce; and accelerate financial sector reforms and inclusiveness; among other needs. USAID MISRA is also building the capacity of the GoM to better engage and strategically communicate its economic plan, progress, and results to the private sector, civil society, and the public. These activities include intensive support to select GoM institutions with institutional reforms, streamlined processes, and digitalization to improve transparency, accountability, access to information, and public services.


Job Description:

The international expert will be responsible for the following tasks:·Referencing international treaties, EU requirements, UNECE resolutions, and international best practices, recommend the legal framework appropriate to be implemented in Moldova, and NARM specifically, for defining training requirements, trainings programs, qualifications, examinations, certifications, and other relevant requirements of maritime/inland personnel, and for mutual recognition of the Moldovan issued documents;

·Cooperate with MISRA staff and other local experts to identify relevant Moldovan legislation and regulations, if any, that should be revised;

·In coordination with NARM and MISRA staff, lead working meetings with appropriate government representatives to develop findings and recommendations, including on international best practices, for a new legal framework and necessary amendments to Moldovan laws and regulations, if any;

·Recommend basic and/or appropriate international qualification requirements, training and certification for masters, officers, and watch personnel on maritime vessels and large yachts consistent with the International Convention on Standards of Training, Certification and Watchkeeping for Seafarers (STCW) and international best practices;

·Recommend a plan or roadmap for further elaboration of the legal and operational framework, based on the identified findings and in coordination with NARM;

·Lead working meetings in Moldova to discuss international treaty commitments, EU requirements, international best practices, and local laws and regulations to be revised, if any, for development of a final report with recommendations.

·Develop outline of findings and recommendations in preparation for the final report;

·Submit a final report recommending the appropriate implementation of the legal framework for Moldova focusing on training requirements, training programs, qualifications, examinations, certifications, and other relevant requirements of maritime/inland personnel, and for mutual recognition of the documents, in compliance with international treaty commitments, EU requirements, and international best practices. The report should provide guidance and recommendations that can be utilized by other experts to draft a new progressive legal framework; and

·Deliver presentation of the final report to NARM, MISRA, and other stakeholders, and adjustments to the final report and recommendations based on their questions and feedback.


The expert will work on the following deliverables primarily remotely, with regular monthly and ad hoc reporting to MISRA on the progress of the work. Up to two trips to Chisinau, Moldova may be required: at the preparation stage; and near the conclusion of the assignment.

Position Location: Remote; Two 1-week trips to Chisinau, Moldova


Qualifications:

·At least 10 years of experience in maritime law or with a maritime agency required;

·Experience with EU accession/association requirements, international conventions, and best practices in respect to training and certification of maritime and inland navigation personnel required;

·University degree in law or maritime issues required;

·Demonstrated knowledge and comparative experience with training and certification of maritime and inland navigation personnel in compliance with EU requirements required; and

Writing and speaking skills in English required; writing and speaking skills in Romanian desired.
